1. Introduction

Thanks for using Resumeow. These Terms of Service ("Terms") cover your use of and access to our services, client software, and websites ("Services"). By using our Services, you agree to be bound by these Terms as well as our Privacy Policy. If you are using our Services as the employee or agent of an organization, you are agreeing to these Terms on behalf of that organization.

2. Service Description & AI Usage

Resumeow utilizes advanced Artificial Intelligence (LLMs) to provide resume analysis, scoring, and feedback. By using the Service, you acknowledge:

• Probabilistic Nature: AI models are probabilistic. Outputs may vary for the same input and may occasionally contain inaccuracies ("hallucinations").
• Advisory Role: Our feedback is for educational and informational purposes. We do not guarantee job interviews, offers, or specific career outcomes.
• No Human Review: Your documents are processed automatically. No human at Resumeow reviews your resume content unless explicitly requested for support purposes.

3. User Content & License

You retain full ownership of the documents and data you upload ("User Content"). By uploading User Content, you grant Resumeow a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, create derivative works (such as transcriptions), and analyze such Content solely for the purpose of providing, improving, and securing the Services.

4. Payment & Credits

• Pre-paid Model: Services are accessed via credits. Credits are deducted at the time a request is successfully processed.
• No Refunds: All purchases are final. We do not offer refunds for unused credits or for dissatisfaction with the AI's qualitative feedback.
• Service Availability: We strive for 99.9% uptime but do not guarantee it. In the event of a system failure where credits are deducted but no result is delivered, your account will be automatically credited.

5. Acceptable Use Policy

You agree not to misuse the Services. For example, you must not:

• Upload content that contains malware, illegal material, or sensitive personal data of others (e.g., medical records).
• Reverse engineer, decompile, or attempt to extract the source code or system prompts.
• Create multiple accounts to bypass usage limits or exploit the referral system ("Smurfing").
• Use the Services to train competing machine learning models.

6. Termination

We reserve the right to suspend or terminate your access to the Services with notice if you materially breach these Terms. We may also terminate your account for prolonged inactivity (over 12 months) with prior notice.

7. Disclaimers & Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RESUMEOW AND ITS AFFILIATES, SUPPLIERS, AND DISTRIBUTORS MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, ABOUT THE SERVICES. THE SERVICES ARE PROVIDED "AS IS." WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT WILL RESUMEOW BE LIABLE FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR (B) ANY LOSS OF USE, DATA, BUSINESS, OR PROFITS, REGARDLESS OF LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES.
